Terms of Service

1. Acceptance of Terms
By creating an account or using Aeris ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms form a binding contract between you (the "Customer" or "you") and the operator of Aeris ("we", "us", or "our").
2. Description of Service
Aeris is a software-as-a-service (SaaS) platform that provides AI-powered business automation tools, including but not limited to:
- AI chat assistant (admin and public-facing widget)
- Appointment and availability management
- Food ordering and menu management
- Staff scheduling and coordination
- Inventory tracking
- Rental management
- Scheduled task automation
- FAQ management
Features available to you depend on your subscription plan and the modules you have enabled.
3. Accounts
3.1 Registration
You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
3.2 Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use the Service. By using the Service, you represent that you meet these requirements.
3.3 Account Security
Notify us immediately at [email protected] if you suspect unauthorised access to your account. We are not liable for losses arising from compromised credentials.
4. Subscriptions and Billing
4.1 Plans
Aeris offers Free and Pro plans. Plan features and limits (including daily AI request caps) are described on the pricing page and in your account dashboard.
4.2 Payment
Subscriptions are billed on a monthly or quarterly cycle as selected during sign-up. Payment is made via bank transfer to the account details shown on your invoice. An invoice is generated automatically at the start of each billing cycle.
4.3 Late Payment
Access to paid features may be suspended if an invoice remains unpaid past its due date. We will provide reasonable notice before suspension.
4.4 Price Changes
We may change subscription prices with at least 30 days' written notice. Continued use of the Service after the effective date constitutes acceptance of the new price.
4.5 Refunds
Payments are generally non-refundable. We may grant refunds at our sole discretion in cases of billing errors or exceptional circumstances. Contact us at [email protected] within 14 days of the charge.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Upload, transmit, or store content that is illegal, harmful, defamatory, obscene, or infringes third-party rights
- Attempt to gain unauthorised access to the Service, its servers, or related systems
- Reverse-engineer, decompile, or disassemble any part of the Service
- Use the Service to send spam, phishing messages, or unsolicited communications
- Scrape or harvest data from the Service beyond what is necessary for normal use
- Resell or sublicense access to the Service without written permission
We reserve the right to suspend or terminate your account for violations of this section.
6. AI Usage and Limitations
6.1 AI-Generated Content
The Service uses large language models (including Anthropic Claude and others) to generate responses. AI output may be inaccurate, incomplete, or inappropriate. You are solely responsible for reviewing AI-generated content before acting on it.
6.2 Usage Limits
Each account has a daily AI request limit set by your subscription plan. Bonus credits may be granted at our discretion. Limits reset daily at 00:00 UTC.
6.3 No Guarantee of Availability
AI provider outages are outside our control. We will make reasonable efforts to restore service but do not guarantee uninterrupted AI availability.
7. Customer Data
7.1 Ownership
You retain all ownership rights to the data you upload or generate through the Service ("Customer Data"). We do not claim ownership of your Customer Data.
7.2 Licence to Operate
You grant us a limited licence to store, process, and transmit your Customer Data solely to provide the Service to you.
7.3 Data Responsibility
You are responsible for ensuring you have the right to upload any data you submit, and that doing so does not violate any third-party rights or applicable law.
7.4 Data Retention and Deletion
Upon account termination, your data is retained for 30 days before deletion, during which you may request an export. After 30 days, data is permanently deleted and cannot be recovered.
8. Intellectual Property
All software, designs, trademarks, and content that form the Service (excluding Customer Data) are our intellectual property or that of our licensors. Nothing in these Terms grants you any rights to our intellectual property other than the limited licence to use the Service.
9. Third-Party Services
The Service integrates with third-party platforms (e.g. Supabase, Anthropic, Resend, Google Calendar, Brave Search). Your use of these integrations is also subject to the respective third-party terms. We are not responsible for the actions or availability of third-party services.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification
You agree to indemnify and hold harmless us and our officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your Customer Data, or your violation of these Terms.
13. Termination
13.1 By You
You may cancel your subscription at any time via your account dashboard or by contacting us. Cancellation takes effect at the end of your current billing cycle.
13.2 By Us
We may suspend or terminate your access immediately if you breach these Terms, fail to pay, or if we reasonably believe your use poses a security or legal risk. We will provide notice where reasonably practicable.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of Malaysia. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
15. Changes to These Terms
We may update these Terms at any time. Material changes will be notified via email or an in-app notice at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance.
